Sweepstakes Description: Starting the month of February, 2010, we will have a Grand Prize drawing once per month for an indisclosed number of months during the 2010 calender year. Each month will feature a different Grand Prize that will be chosen, at random, from our powersports vehicles (any ATV, UTV, Go-kart, motor scooter or motorcycle) featured daily on our website. There will be one Grand Prize awarded to one winner for each month the Sweepstakes is in effect. All of the entries collected during the calender month will go into the drawing for the Monthly Grand Prize being offered for that specific month. The Grand Prize drawing for that month will be held by the 10th of the following month.
For the month of February, 2010, the Grand Prize will be a Znen 50QT-A 50cc Scooter in Blue and White, fully assembled with PDI, custom crated and ready to ride, with cover and performance upgrade, which has an ARV of $1,717. Eligibility: This Sweepstakes is open only to legal residents of the U.S. who are 18 years of age or older as of January 31, 2010, except employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of where they reside) of BMS as the Main Sponsor. Main Sponsor reserves the right to conduct a background check on any potential Grand Prize Winner and reserves the right in its sole discretion to disqualify any person based on such background check if Main Sponsor determines in its sole discretion that awarding the prize to such potential Grand Prize Winner might reflect negatively on Main Sponsor or any of the Participating Product Sponsors.
How to Enter: Beginning at 9:00 a.m. Pacific Time ("PT") on 1st day of each month, starting with Febrauary, 2010 until 5:00 p.m. PT on last day of each month, starting with February, 2010 (the "Sweepstakes Period"), and continueing on a monthly basis until the Monthly Giveaway Sweepstakes is cancelled, you may enter the Bandit MotorSports ("BMS") 2010 Monthly Giveaway Sweepstakes (the "Sweepstakes") in any of the following two (2) ways:
(i) Online - Make a purchase from the BMS website of any product and you will be automatically entered into that months Grand Prize drawing. Each month, there will be a different Grand Prize awarded and any and all entries made during a specific calender month will be for that months specific Grand Prize drawing. For every purchase made, a single entry into the Monthly Grand Prize drawing will be placed for every $10 in value of the total purchase. For example, if the total of your purchase made is $4,345, then there would be 434 entries placed in your name for that specific Monthly Grand Prize drawing.
(ii) Via Mail - Hand print your name, complete address, phone number (area code included) and date of birth either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mailing the postcard or paper in an envelope with proper postage affixed to: Monthly Giveaway Sweepstakes Entry, 195-C Cap Court, Eugene, OR 97402 (the "Mail-In Address"). Entrants using U.S. mail may enter as often as they wish. Mail-in entries must be postmarked by the last day of the month for the specific Monthly Grand Prize drawing, 2010 and received by the 10th of the following month, 2010. Limit one (1) entry per stamped outer envelope. Mechanically reproduced or hand-stamped entries or mailing labels or entries generated by script, macro or other automated means and entries by any means which subvert the entry process will not be accepted. Incorrect, illegible, and incomplete entries are void. All eligible entries will be entered in the Monthly Grand Prize Drawing. Bandit MotorSports ("Main Sponsor") is not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including, without limitation, errors that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials; and any mail or entries which are late, lost, incomplete, misdirected, stolen, garbled, mutilated, illegible or postage due, or any combination thereof. Proof of mailing, in person submission, or online submission is not considered proof of delivery or receipt. All entries become the property of BMS and will not be returned.
Grand Prize Drawing: The potential Grand Prize Winner will be selected in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about the 10th of each month, starting with March 10, 2010, by S Preston, an independent judging individual ("Sweepstakes Administrator"). The odds of winning the Grand Prize depends upon on the number of eligible entries received for the entire Sweepstakes Period.
Winner Selection and Notification: Main Sponsor anticipates that the potential Grand Prize Winner will be contacted in person on or about 14th of each month, starting with March 14, 2010 (subject to change) in the form of a registered letter, e-mail and/or telephone call. Potential Grand Prize Winner will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted by law), and return same, fully-executed, within five (5) days of date of issuance of prize notification. If Main Sponsor is unable to contact the potential Grand Prize Winner within five (5) days of date of the initial attempt, if the potential Grand Prize Winner fails to return all requested forms fully-executed by the specified date, or if the potential Grand Prize Winner fails to comply with these Official Rules, his/her place as a Grand Prize Winner will be forfeited and an alternate Grand Prize Winner may be selected, at Main Sponsor's sole discretion.
Grand Prize: One (1) Grand Prize Winner shall win the Monthly Grand Prize consisting of the specifc vehicle offered for that months Grand Prize Giveaway. All decisions related to the Monthly Giveaway Sweepstaakes shall be at Main Sponsor's sole discretion. Actual value of the Monthly Grand Prize depends on market fluctuations and the prize offered. The Monthly Grand Prize shall be conveyed to the Monthly Grand Prize Winner without representations or warranties, express or implied, other than those, if any, provided by the manufacturer from whom BMS has agreed to acquire the Monthly Giveaway Grand Prize, and other than any applicable manufacturers' warranties. Sales taxes shall be the sole responsibility of the Monthly Grand Prize Winner, as will all current and future costs, fees, and expenses related to the maintenance of the Monthly Grand Prize commencing as of the date the Monthly Grand Prize Winner accepts the Monthly Grand Prize. The Main Sponsor shall not be responsible for shipping delays. For the vehicle, the Monthly Grand Prize Winner is solely responsible for all taxes, registration, insurance, license, and excess shipping costs (to Alaska, Hawaii or any U.S. territory).
General Prize Conditions: All costs, taxes, fees, and expenses associated with the prize or the acceptance and use of any element of the prize not specifically addressed above are the sole responsibility of the winner. All federal, state, and local taxes on prize are winner's responsibility. The specifics of all aforementioned elements of the prize in the Sweepstakes shall be solely determined by Main Sponsor. Some restrictions may apply. Prize cannot be transferred, substituted or redeemed for cash except at Main Sponsor's sole discretion. Main Sponsor reserves the right to substitute the prize, or portion(s) thereof, with a prize of comparable or greater value, at its sole discretion.
General Conditions: Main Sponsor and Sweepstakes Administrator's decisions with respect to the Grand Prize Winner and other matters pertaining to the Sweepstakes shall be final and binding and are subject to change. By entering into the Sweepstakes, each entrant consents to the use by Main Sponsor of his/her name, photograph, biography for advertising and promotional purposes to announce the potential Grand Prize Winner on a date to be determined by Main Sponsor (or as otherwise set forth above) in any and all media, including online announcements now or hereafter known, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law.
General Release: By entering, all participants and/or entrants release the Main Sponsor from and against all claims and damages arising in connection with each entrant's participation and/or entry in the Sweepstakes and/or his/her receipt or use of the prize (including any injury or harm resulting from the use of the vehicle or any travel or activity related thereto) awarded in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer's terms. This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws and regulations. Void outside the U.S. and where prohibited by law.
Revocation/Suspension/Termination: If, in the Main Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Main Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the BMS Website.
Winner's List Request: Beginning on or about March 16, 2010 you may obtain the name of the Monthly Grand Prize Winner either by going to the Bandit Website (www.bandit-motorsports.com/sweepstakes.html) or mailing a self-addressed stamped envelope to: Monthly Giveaway Sweepstakes Winner's List, 195-C Cap Court, Eugene, OR 97402.
